1.1 The Team HARD. VWR Car Raffle (“the Raffle”) will be operated as a Society Raffle under the Gambling Act 2005 as amended (“the Act”) and is licensed by the Gambling Commission.
1.2 The Raffle is promoted by the Promoter and conducted for the benefit of the RAF Benevolent Fund.
1.3 The person responsible for the promotion of the Raffle is Tony Gilham, team principle, Team HARD. Racing.
1.4 By entering the Raffle, ticket purchasers agree to be bound by these rules.
“Act” The Gambling Act 2005.
“Raffle” The Team HARD. VWR Car Raffle.
“Draw” The process by which winners are selected.
“Rules” The rules of The Team HARD. VWR Car Raffle as set out below.
“Chance” The entry into the Raffle.
2.1 Entry into the Raffle
The Raffle is promoted in accordance with the Gambling Act 2005 as amended (‘the Act’) throughout Great Britain. Only residents of Great Britain can enter the raffle.
In order to comply with the Act, during the purchase of Raffle Chances you will be required to confirm that:
(a) You are at least 16 years of age.
2.2 If, upon winning the prize in the Raffle, you are not able to prove that you have met the criteria specified in Rules 2.1 above then you will not be entitled to receive that prize.
2.3 In order to comply with the Act, raffle chances that have been purchased and entered into the draw for which they were intended are prohibited from being subsequently refunded.
2.4 By entering into the Raffle you agree to be bound by the Rules, and applicable provisions of the Act and any relevant regulations made thereunder from time to time. Team HARD. Racing shall not be liable for any loss or damage (including loss of the opportunity to enter the Raffle and/or the right to receive a prize) suffered by you if you have not complied with the Rules.
2.5 This Raffle is a form of gambling. Participants are encouraged to gamble sensibly. Should gambling become a problem we recommend you contact the Gamble Aware helpline on 0808 8020 133 or visit the website on www.gambleaware.co.uk.
2.6 Directors and employees of the Team HARD. Racing, are not permitted to enter the raffle.
3. Purchasing a chance in the raffle
3.1 You can only enter the Raffle by the purchase of a ticket.
3.2 You will be required to provide the following information:
(b) Confirmation that you are over 16 years of age, in order to ensure compliance with the Act.
(c) The number of Chances in the Raffle you wish to purchase.
3.3 You will also be required to provide information relating to the purchase of you Chances. Payment may be made via the following methods and the relevant information will vary depending upon the payment method:
(a) Pay Pal.
(b) Credit/Debit Card – cardholder name, card number, expiry date, card security code and address of the particular card required.
3.4 Team HARD. Racing shall be entitled to take any steps necessary to verify the above information and to process your purchase. Team HARD. Racing may (in its absolute discretion) refuse to accept an application for an individual to support the Raffle.
3.5 It is your responsibility to ensure that the personal information you provide to us is accurate.
3.6 Each raffle ticket number is unique.
3.7 The price for each Chance is £50.
3.8 Your Chances and therefore associated Raffle Ticket Number(s) will not be entered into the Draw unless Team HARD. Racing has received all amounts payable (cleared funds) relating to your Chances by the published cut off date of the draw. If there is a dispute regarding whether Chances have been paid for then such dispute shall be decided by the Raffle promoter.
3.9 Team HARD. Racing may cancel your entry into the Raffle (in its absolute discretion) at any time prior to the published cut off date Team HARD. Racing will notify you accordingly as soon as reasonably practicable and will reimburse any amounts which have been paid. Other than the reimbursement of any such amounts Team HARD. Racing shall not be liable for any loss or damage (including loss of the opportunity to enter the Raffle and / or the right to receive a prize) suffered by you in relation to such cancellation.
3.10 All customer funds paid to the Raffle are held in a separate account to maintain a separation from Team HARD. Racing’s own trading income to protect those funds in the event of insolvency.
4.1 The Draw will take place at BTCC 2018 media day at Donington Park.
4.2 If for any reason the Draw date needs to be deferred from that stated on the raffle ticket and Team HARD. Racing website, all reasonable steps will be taken to ensure participants are made aware of the changes.
4.3 In order to comply with the Act only those Chances for which payment has been received are eligible for entry into the Draw.
4.4 If not all 1000 tickets are sold the draw will be delayed until such time as all tickets are sold.
5.1 The Team HARD. Racing VWR Golf car is the sole prize.
5.2 In the event that the winner does not wish to keep the car, he or she is required to agree to retain the car for a minimum one year period. If the winner wishes to sell the car during this period, the car must be sold back to Team HARD. Racing at a price to be determined by them, taking into consideration the condition and mileage on the car.
5.3 The results of the Draw will be published on the Team HARD. Racing website and social media channels on the day of the draw and will also be published.
5.4 Winners will be notified by telephone on the day of the draw.
5.5 If, upon winning the car in the Raffle, you are not able to prove that you have met the criteria specified in Rules 2.1 above then you will not be entitled to receive that prize.
5.6 By accepting the prize, the winner agrees for the Team HARD. Racing to use the name of the winner, their photograph and audio/or visual recordings of them in any publicity.
5.7 The insurance, maintenance and running costs of the car will be the responsibility of the winner from the time of collection of the car.
6. Suspension of the Raffle
6.1 Team HARD. Racing may (at its absolute discretion) suspend the Raffle for any period of time. During such period the RAF Benevolent Fund shall retain any amounts which were paid prior to such suspension taking effect.
6.2 You will be notified of further details regarding the resumption of the raffle or otherwise as soon as reasonably practicable after the date of suspension in writing.
7.1 Team HARD. Racing shall not be liable to you for any loss or damage suffered by you arising from:
(a) Any delays or failures in the postal service or other delivery methods used by the RAF Benevolent Fund or you from time to time.
(b) Any delays or failures in any systems used by the RAF Benevolent Fund or you to transmit emails.
(c) Any failure in any software or other systems used by the RAF Benevolent Fund for the administration of the Lottery.
(d) Any delays of failures in the banking system used by the RAF Benevolent Fund or you.
(e) Any failure to enter your Chance into the Draw.
(f) Any event beyond the reasonable control of the RAF Benevolent Fund.
7.2 The RAF Benevolent Fund shall not be liable to you in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Raffle (including loss of the opportunity to enter the Raffle and/or the chance of winning the car).
8.1 Any complaints relating to the Raffle should be sent in writing, giving full details of the complaint and supporting documentation to:

8.2 The Promoter’s decisions made pursuant to the Rules shall be final and binding.
8.3 Save where the Rules expressly provide otherwise, the Promoter shall not be obliged to enter into any correspondence.
8.4 If a complaint cannot be resolved by Team HARD. Racing, the issue will be referred to the Independent Betting and Adjudication Service (IBAS).
9. Self Exclusion
9.1 Should you feel that you have issues with gambling and wish to be self-excluded from our raffle, please phone our helpline number and request a self-exclusion form.
9.2 There is a minimum period of six months self-exclusion.
9.3 We will not target you with any marketing material during the self-exclusion period and will remove your name and details from any marketing databases used by ourselves.
9.4 You will need to contact us after your period of self-exclusion to reinstate your eligibility to enter the Raffle.

10. Data Protection
10.1 Team HARD. Racing is committed to protecting your privacy. Data that we collect from you is used lawfully in accordance with the Data Protection Act 1998 and is used solely for the purpose of processing your purchase of Raffle chances, subsequent entry into the Raffle, and informing you if you have won the car.
10.2 You have the right to access the information we hold about you. To obtain this information, please contact Team HARD. Racing in writing. You may be asked to provide proof of your identity prior to personal information being disclosed to you.
10.3 We may be obliged to disclose your personal information if required to do so by law, for example to statutory bodies such as the Gambling Commission or other government bodies.
11. Proper Law and Jurisdiction
11.1 The Laws of England and Wales shall govern the interpretation and/or enforcement of these Rules and Team HARD. Racing and all entrants hereby submit to the exclusive jurisdiction of the English courts.
